1. INTRODUCTION
This website is operated by VerVeLush B.V. Throughout the site, the terms “we,” “us,” and “our” refer to VerVeLush. By accessing or purchasing from this website, you agree to be bound by the following Terms & Conditions, including all policies referenced herein or available by hyperlink. If you do not agree to these Terms, you may not access the website or use any services.
2. GENERAL CONDITIONS
2.1 We reserve the right to refuse service to anyone at any time for any reason.
2.2 You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from us.
2.3 We reserve the right to modify the contents of this site at any time without obligation to update any information.
3. PRODUCTS & SERVICES
3.1 Limited Editions: Each artwork is produced in a fixed quantity and will never be reprinted once sold out.
3.2 Made-to-Order: All prints are created upon purchase, ensuring exclusivity and reducing waste.
3.3 No Mass Production: We do not engage in mass production or third-party resales.
4. PRICING & PAYMENT
4.1 Prices for our products are subject to change without notice.
4.2 We reserve the right to refuse or cancel orders at our discretion, including cases of suspected fraud.
4.3 By making a purchase, you authorize us to charge your selected payment method for the total order amount.
5. ORDER ISSUES & SHIPPING
5.1 Damaged or Incorrect Items: If an item arrives damaged or incorrect, you must contact us within 7 days of delivery with photographic evidence. Upon verification, we will issue a replacement at no cost.
5.2 Lost Orders: If a package is lost in transit with no courier updates:
- Standard Shipping: Replacement issued after 30 days.
- Express Shipping: Replacement issued after 20 days.
5.3 Delivery Times: Estimated delivery times vary based on location and shipping method. We are not responsible for delays due to customs, natural disasters, or courier issues.
6. RETURN & REFUND POLICY
6.1 Returns & Eligibility
Customers may return eligible artwork within 30 days of delivery. All returns must be in original condition with all packaging materials included. Returns are only accepted for undamaged artwork.
6.2 Return Shipping Responsibility
The return shipping cost is the responsibility of the customer. A prepaid return label will be provided upon request, and the shipping cost will be deducted from the refund amount.
6.3 Return Processing & Fees
Due to the limited nature of our editions, a restoration and handling fee will apply to all returns. This fee covers the management of limited edition inventory and reallocation.
The following return processing fees apply per artwork (return shipping label cost deducted separately from the refund):
- €75 for artworks priced under €250
- €125 for artworks priced between €251 – €400
- €175 for artworks priced between €401 – €600
- €225 for artworks priced between €601 – €800
- €300 for artworks priced over €801
For multiple returns, the following discounted structure applies:
- The first artwork is charged the full fee
- The second artwork is charged 50% of the fee
- The third and subsequent artworks are charged 25% of the fee
6.4 Refund Timeline
Once a return is received and inspected, refunds will be processed within 7-10 business days, minus applicable fees. Refunds will be issued to the original payment method.
6.5 Non-Returnable Items
- Artwork that has been damaged, altered, or used improperly
- Custom or personalized orders
- Any artwork marked as Final Sale
This policy ensures transparency while maintaining the exclusivity of our editions.
7. LIFETIME GUARANTEE
7.1 We stand by the craftsmanship of our prints. If an artwork fades, discolors, or degrades under normal indoor conditions, we will replace it free of charge.
7.2 This guarantee does not cover accidental damage, misuse, improper framing, or exposure to direct sunlight or moisture.
8. ORDER CANCELLATIONS & MODIFICATIONS
8.1 Due to our made-to-order production, orders can only be modified or canceled within 10 minutes of purchase. After this window, production begins immediately, and changes cannot be accommodated.
9. EXCLUSIVITY POLICY
9.1 We collaborate with artists under agreements that ensure exclusivity of their work on our platform. However, we cannot guarantee that an artist will not sell their artwork elsewhere in violation of our agreement. While we take necessary legal actions in such cases, VerVeLush is not liable for external sales made by artists.
10. INTELLECTUAL PROPERTY
10.1 All content on this website, including but not limited to images, text, graphics, and branding, is the exclusive property of VerVeLush B.V. and is protected under Dutch copyright and intellectual property laws. Unauthorized reproduction or distribution may result in legal action.
11. LIMITATION OF LIABILITY
11.1 VerVeLush shall not be held liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill arising from the use of our products or services. Our liability shall never exceed the amount paid for the purchased product.
12. FORCE MAJEURE
12.1 We shall not be held liable for any delay or failure in performance due to events beyond our reasonable control, including but not limited to natural disasters, strikes, supply chain disruptions, cyber-attacks, or government actions.
13. GOVERNING LAW
13.1 These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising shall be resolved exclusively in the courts of Enschede, Netherlands.
14. CHANGES TO TERMS
14.1 We reserve the right to update or modify these Terms at any time. It is your responsibility to review them periodically. Continued use of the website after modifications constitutes acceptance of the changes.
